TERMS OF USE

Effective January 10, 2017

All products, services and support on this site are offered by and through Hubble Connected HK Ltd (HCHK). The products displayed are the property Binatone Electronics International Ltd (BEIL).

As a user of this Site (referred to as “you/your”) you acknowledge that any use of this Site is subject to our Terms of Use below.

We occasionally modify our Terms of Use and will post those changes on this page. This document supersedes all prior representations and agreements between you and Hubble Connected relating to the use of the Site.

1. General

1.1 We reserve the right to change these Terms of Use at any time. Any such changes will take effect when posted on the Site and it is your responsibility to read the Terms of Use on each occasion you use the Site. Your continued use of the Site shall signify your acceptance to be bound by the latest Terms of Use.

1.2 The information on this Site does not constitute any binding offer to sell products described on the Site or to make such products available in your country.

2. Support Terms & Conditions

2.1 Please see the FAQs and Quick Start guides for information on how to use all the products listed on the site. All requests that you place on the Site will be subject to acceptance in accordance with these terms and conditions.

2.2 We will send to you an acknowledgement email detailing the Product you have requested information or support around. Please note that this email is not an order confirmation or order acceptance from Hubble Connected.

2.3 The contract between us (“Contract”) will only be formed when we send your request.

2.4 The Contract will relate only to the specific information requests and will not form part of the warranty of the product.

3. Response Time Terms & Conditions

3.1 Estimated timescales are specified in Response to Information and also when you send your request. Your request will be fulfilled on our best endeavours by the response date set out in the Confirmation or, if no date is specified, within thirty days of the request.

3.2 We make every effort to deliver Responses within the estimated timescale, however delays are occasionally inevitable due to unforeseen factors. Subject to clause 13, Hubble Connected shall be under no liability for any delay or failure to deliver the within estimated timescales.

3.3 We will deliver the Response to the email address you provided us.

4. Intellectual Property

4.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of the Site shall remain at all times vested in us. You are permitted to use this material only as expressly authorized by us.

4.2 You acknowledge and agree that the material and content contained within the Site is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this Site. You further acknowledge that any other use of the material and content of this Site is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

5. Liability

We will use reasonable endeavours to verify the accuracy of any information on the Site but we make no representation or warranty regarding the contents or availability of the Site or that it will be timely or error-free, that defects will be corrected, or that the Site is free of viruses or bugs and HCHK accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the Site.

6. Privacy Policy

Hubbleconnected.support and associated domains represents the products and information of Hubble Connected HK Ltd. and is operated by Hubble Connected HK Ltd.

The Terms of Use of the Site applies to and recognizes the collection of personally identifiable information (‘Personal Information’) that is collected from you, such as name, physical address, email address and telephone number. A second classification of public data (‘Non-Personal Information’) is also generated by the Site in customizing the user experience. The Privacy Policy is located at hubbleconnected.support/privacy and all aspects of the Site are restricted by that policy. In the event of a disagreement with this Privacy Policy it is that policy that will be in force.

7. Contact Information for Hubble Connected

Contact phone numbers and e-mail addresses are published on the Website at hubbleconnected.support and this information will remain accurate at all times. General inquires or notifications can be sent to support@hubbleconnected.com and a representative will make contact. You should be certain to include a clear Subject Line, a valid phone number and any other relevant information at a minimum to ensure a quicker response.

It is important to note that e-mails will never be sent to you requesting Personal Information be provided via e-mail. The mechanism for collection and updates will always be either the Service (forms on the Website, prompts) or phone conversation after identity has been verified.

9. Use of Personal Information

9.1 HCHK will use your personal information for the following purposes with consent inferred:

9.1.1 to provide you with a convenient, personalized experience on the Website and Service;

9.1.2 to provision services and products requested by you and notify you as such;

9.1.3 to enable staff, vendors and contractors to provide and assist in the support of such services and products to you;

9.1.4 to generate statistical information and demographics about our Service;

9.1.5 to make improvements to interface, performance and service quality for the Service.

9.2 HCHK will use your Personal Information only with explicit consent from you:

9.2.1 to market products, updates, special offers and services to you that we believe may be of interest;

9.2.2 to run promotions and special activities that enhance the Service experience.

Under no circumstance will HCHK disclose or share your personal information with any third party unless you have given express permission.

HCHK may also use and disclose your Personal Information when you have been involved in violations of our Terms of Site. These cases may involve law enforcement personnel to detect and prevent unlawful access to your Personal Information or to investigate activities that threaten the integrity of the Service and our network.

HCHK may use your Personal Information as required by courts or administrative agencies in connection with a sale, merger, or reorganization of the business. Those parties are bound by strict contractual provisions with our Service and only have access to Personal Information needed to perform their job functions, and may not use it for other purposes. They will process the Personal Information in accordance with this Privacy Policy.

9.3 If you wish to prevent or disable cookies

You can always elect to not use the Website if cookies are not desirable and by doing so are not permitted to use the Service. However, there are several ways to disable cookie functionality, though the site may not offer all of its features without them:

Set the Internet browser to prompt when a cookie is received or disable cookies altogether. Check your browser’s Help menus;

Delete the cookies from the browser cache and Temporary Internet Files after leaving the Website;

Enable private browsing by enabling ‘Incognito’ in Chrome, ‘Private Browsing’ in Firefox / Safari or ‘In Private’ in Internet Explorer.

9.4 If you wish to use cookies but opt-out of targeted advertising

If you wish to notify third-party advertisers that you do not wish to participate in their programs using cookies it is recommended that you visit http://www.networkadvertising.org/choices/ and follow the detailed instructions there.

To opt-out of Google Analytics go to https://tools.google.com/dlpage/gaoptout and install the browser add-on.

10. Third-party Interactions on the Website

HCHK’s Website(s) may allow third parties to provide products and services directly to HCHK customers. Such relationships are often designated with a ‘Provided By’ or ‘Powered By’ company logo or other similarly worded designation. When processing or performing the named function that party will collect your information and share Personal Information with HCHK. You may review the privacy practices of the third party either by clicking the link on the bottom of the page or by clicking on the ‘Provided by Company’ logo, which will take you to their Website.

Software that is downloaded or installed from the HCHK Website may be provided by a third-party developer / license that requires Personal Information to enroll. If the product is provided by a third-party a link will be provided to the organization’s Website where the Privacy Policy and Terms of Service can be examined. Activating the link or downloading the software grants HCHK permission to share the required Personal Information with the third-party Website and accepts that HCHK is not responsible for the conduct, data policies or security of the third-party. All offers, links, promotions and services that advertise a third-party are separate and distinct from HCHK Website(s) and excluded from our policies that protect consumers.

Partners, promotions and other third-party content is validated against standards and conditions but it always possible that something slips through checks and balances. If any partner or content is discovered to be fraudulent or employ questionable conduct we will remove their advertisements, product or service from the Website. Report all scams or abuses to support@hubbleconnected.com

11. Security of Personal Information

HCHK has invested and deployed a wide variety of technology and security features to make reasonable efforts to ensure the privacy of information on its network. Operations guidelines ensure privacy is safeguarded at every level of our organization.

Suspicion of a security breach or compromise of your personal information should be immediately reported to Customer Services to minimize damage and risk. The agent will assist with securing the account and investigating the extent of the breach. Consumer Protection Law protects any victim of fraud from charges or penalties if the activity is quickly reported and full cooperation is provided to the Vendor or Service Provider to investigate.

A breach that is not reported within 24 hours of detection can increase risk to the platform and other third-parties. This is a violation of the Terms of Site and it will result in immediate suspension of the ‘account’ and may lead to legal action from HCHK or from third-party Partners if the conduct is found to be irresponsible.

12. Security of Digital Transmissions

Key communications with the data center are encrypted in transit using Secure Sockets Layer (SSL) with Transport Layer Security (TLS) to restrict third-party eavesdropping to the Service. This mechanism will protect the transmission of Personal Information as it travels to our infrastructure, where it is protected by our security. The browser will display a lock icon to validate the use of SSL on secure parts of the site where forms collect data, payments are processed and Personal Information is handled or updated.

HCHK uses industry standard browser encryption with a bit-strength of 128-bit or 256-bit to secure communications.

Personal Information which you voluntarily include and transmit through publicly accessible forums (i.e., chat rooms, blogs, instant messaging) may be viewed and used by anyone with access to such forums. HCHK assumes no responsibility for anything that is shared from the Service to one of these mediums.

13. Personal Information

Personal Information about you is available at your request and can be changed at your request. All necessary steps must be taken to validate your identity before the request is fulfilled. Personal Information will be requested and compared to the records the Service has on file to the satisfaction of the HCHK representative. Accounts that have been compromised in the past may require multiple validation tests to satisfy the requirement. This is for your protection and cooperation is expected.

You are responsible for ensuring that the information the Service has on file for you is accurate at all times.

14. Third-Party Websites and Services

Our Service may contain links to other Websites and services not maintained by HCHK. In addition, other Website(s) and services may also reference or link to HCHK. We encourage you to be aware when you leave our service, or surf the Internet, and to be aware the privacy statements will differ. We do not endorse, screen, or approve, and are not responsible for the privacy practices or the content of, such other Websites and services. HCHK does not assume any liability for third parties that have been provided with information as permitted by this Privacy Policy or who have collected information as permitted by this Privacy Policy (such as advertisers using third party cookies).

We are not responsible for the Personal Information collected from any third-party Website or service. Requests to de-list or delete must be addressed with the responsible party. Partner organizations are actively involved in the delivery of the Service and the posted Privacy Policy for these vendors may follow different guidelines.

15. Contract Provisions

15.1 This Agreement shall be construed and controlled by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be determined by arbitration administered by a single arbitrator appointed by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules. The location of any such arbitration shall be Hong Kong.

15.2 To provide increased value to our customers, we may provide links to other Sites for you to access at your sole discretion. You acknowledge and agree that we are not responsible for the availability of such external Sites, the content of those Sites or for any use you may make of them.

15.3 You may not assign, sub-contract or transfer any of your rights or obligations under these Terms of Use to any third party unless agreed upon beforehand in writing by HCHK. We may transfer, assign, or sub-contract the benefit of the whole or part of any of our rights or obligations under these Terms of Use to any third party.

15.4 If any portion of these Terms of Use is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other clauses of these Terms of Use shall not be affected.

15.6 No delay or failure by HCHK to exercise any powers, rights or remedies under these Terms of Use will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorized representative of HCHK.

15.7 When using the Site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on the Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

15.8 All notices given by you to us must be sent to support@hubbleconnected.com or Hubble Connected HK Ltd. RM 902, Wilson House, Hong Kong, Central. Notice will be deemed received and properly served immediately when posted on our Site, twenty-four (24) hours after an email is sent, or ten days after the date of posting of any letter.

16. Changes to Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions from this policy at any time.

You are responsible for checking the new policy and understanding the changes. It is recommended that periodic visits to the Website to view the Privacy Policy or follow up when the notification e-mails.
